赵本山在兰州打赢肖像权官司获赔10万元

1月13日，赵本山状告兰州万顺通航空票务服务有限公司(以下简称万顺通公司)、深圳市及西宁市万顺通航空票务有限公司肖像侵权案在兰州中院一审宣判，法院判决兰州万顺通公司在判决生效30日内，通过《甘肃日报》向赵本山赔礼道歉；兰州万顺通公司赔偿赵本山因肖像权被侵害造成的利益损失9万元，合理费用支出1万元，合计10万元。深圳及西宁万顺通公司负连带责任。
在庭审中，赵本山代理人出示的证据显示，非标件，2009年7月兰州万顺通公司擅自使用赵本山的形象，为其航空票务服务做广告，在兰州一家广告公司的楼宇液晶电视广告系统上每天滚动播放达120次。据此赵本山代理人表示，兰州万顺通公司的行为严重损害了赵本山等人的名誉，误导了广大消费者，侵犯了赵本山的肖像权和名誉权，造成了极坏的社会影响。且西宁及深圳万顺通票务公司共同使用兰州万顺通航空的品牌，利用该广告的广告效应扩大其影响，开展业务，并获得利益，应当承担连带赔偿责任。赵本山要求法院判令三被告立即停止侵权并登报赔礼道歉，消除影响，并支付合理支出、直接损失等共计200万元。

在案件审理过程中，三被告的代理人始终坚持认为，兰州万顺通公司的广告片是动态的卡通动漫广告片，而且卡通动漫的形式是通过电脑动画软件制作的，防火包，绝对没有任何肖像权人的存在。

针对被告不构成侵犯肖像权的主张，法院在审理中认为，兰州万顺通公司在广告片中反映的场景和角色设置与赵本山的小品《不差钱》相雷同，容易使一般观众产生该卡通人物即为原告赵本山的合理联想。被告兰州万顺通公司为经营目的，未经本人同意非法使用赵本山卡通形象做广告宣传，符合肖像侵权构成要件，侵犯了原告赵本山的肖像权。据此，法院对原告的利益损失酌情予以支持，遂作出如上判决。
